Lasting Power of Attorney
“Oh, what a noble mind is here o'erthrown!” (Hamlet Act 3, Scene 1)
When we are in good health and in full control of our faculties, we like to believe that it will continue indefinitely and prefer not to think of less happier scenarios. Unfortunately, people do get ill and our mind often deteriorates especially as we get older. When this happens, those who care for you must take control both of your health and property. There is however no automatic legal authority for your loved ones and those closest to you to assume the control if this is required.
You can prepare for such an eventuality by registering a Lasting Power of Attorney. This is where you nominate one or more attorneys such as a close relative or a friend to act on your behalf in the event that you lose mental capacity to manage your own affairs. There are two types of Lasting Power of Attorney: for your financial affairs and for your health and welfare. We can advise on a Lasting Power of Attorney, prepare one for you and deal with the registration.
